1. Acceptance of Terms

These Terms and Conditions ("Terms") govern the use of the HestiaBot service ("Service"), an AI-powered virtual assistant provided by Hestia Properties S.r.l. ("Provider", "we", "our").

By using HestiaBot through Facebook Messenger, Instagram or other supported platforms, the user ("User", "you") fully accepts these Terms. If you do not accept these Terms, please do not use the Service.

2. Service Description

HestiaBot is an automated chatbot that uses AI technologies to: provide information about services, answer FAQs, assist users in navigating offerings, and collect requests to forward to our team.

3. Usage Requirements

• Be at least 18 years old or the legal age in your country
• Have a valid account on the platform used (e.g. Facebook, Instagram)
• Comply with the messaging platform's terms of service
• Provide truthful information in interactions

4. Permitted Use

The following is strictly prohibited:

• Using the Service for illegal or unauthorized purposes
• Attempting to interfere with the chatbot or underlying systems
• Sending offensive, defamatory, obscene or illegal content
• Attempting automated data extraction (scraping)
• Impersonating other people or entities
• Using the Service for spam or unauthorized marketing
• Attempting to circumvent security measures

5. Service Limitations

5.1 Nature of Responses

• Responses may not always be complete or up-to-date
• The chatbot may not correctly understand complex or ambiguous requests
• Some information may require verification by our team

5.2 Availability

• Interruptions may occur for scheduled or emergency maintenance
• Availability depends on third-party platforms (Meta)
• We do not guarantee specific response times

6. Intellectual Property

All intellectual property rights related to the Service, including software, content, trademarks, logos and design, are and remain the exclusive property of Hestia Properties S.r.l. or their respective licensors.

7. Privacy and Personal Data

Personal data processing is governed by our Privacy Policy, which is an integral part of these Terms.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee accuracy, completeness, reliability, fitness for specific purposes, absence of errors, or uninterrupted availability.

9. Limitation of Liability

Hestia Properties S.r.l. shall not be liable for any direct, indirect, incidental, special or consequential damages arising from the use of the Service. Total liability shall not exceed €100.

10. Indemnification

The User agrees to indemnify and hold harmless Hestia Properties S.r.l. from any claims, damages, costs or expenses arising from violation of these Terms, misuse of the Service or violation of third-party rights.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after publication of changes constitutes acceptance of the new Terms.

12. Suspension and Termination

We reserve the right to suspend or terminate access in case of violation, and to modify, suspend or discontinue the Service at any time.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law. The Court of Milan shall have exclusive jurisdiction, except where mandatory consumer protection provisions apply.

14. General Provisions

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement.
• Waiver: Failure to exercise a right does not constitute waiver.
• Severability: If a provision is invalid, the remaining provisions remain valid.
• Assignment: The User may not assign rights without our written consent.
